El paisaje chaqueño, las perturbaciones y la Ley 26331

Abstract

La pregunta básica de la Ley Nac. N° 26331, Presupuestos Mínimos de Protección Ambiental de los Bosques Nativos, es qué debemos conservar. Según la Real Academia, ‘bosque’ es un ‘sitio poblado de árboles y matas’. ¿Es un ecosistema o una comunidad vegetal’? ¿Dónde empieza y dónde termina? Como ecosistema, un ‘bosque’ está sujeto a perturbaciones que colaboran en su existencia a través del tiempo, y que forman parte de su esencia, por ej., mantienen su diversidad vegetal y de fauna. Las perturbaciones, especialmente las naturales, no fueron tenidas en cuenta por la citada Ley, que adoptó una visión estática del bosque, propia de una tarjeta postal. Se analizan algunas inconsistencias en la definición del tipo de vegetación nativa ‘bosque’ de la región chaqueña, en la interpretación de su mapeo y su dinámica. Se proponen soluciones a dichas inconsistencias.

The basic question of the National Law #26331 (Minimal Requirements for the Environmental Protection of Native Forests) is what we ought to conserve. According to the definition, a ‘forest’ is a ‘site populated with trees and scrubs’. Is it an ecosystem or a plant community? Where does it begin and where it ends? As an ecosystem, a ‘forest’ is influenced by inherent disturbances that keep wildlife and vegetal diversity ‘going’. Disturbances, especially natural ones such as fire were not considered by the Law, which adopted a static approach, like a postcard. Some of the inconsistencies of the Law are analyzed, such as the definition of a native forest in the Chaco region, and in the interpretation of its dynamics and mapping. Some solutions are proposed.
